1.3 ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS
Validation of the general terms and conditions shall be deemed to have the same effect as the internet user’s signature. The internet user acknowledges the evidentiary value of the website publisher’s automatic recording systems and, unless they provide evidence to the contrary, waives the right to challenge them in the event of a dispute.
Acceptance of these general terms and conditions requires internet users to have the necessary legal capacity, or, failing that, to have authorization from a guardian or curator if they lack legal capacity, or from their legal representative if they are minors.
2. PREAMBLE
When using the customization service, customers also undertake, without any limitation or reservation, to:
- use the services provided by the publisher responsibly,
- respect the rights of third parties,
- comply with all applicable legislative and regulatory provisions,
- Do not upload content that is racist, contrary to public order or accepted standards of decency, or in breach of any applicable legislative or regulatory provision.
Customers use the service at their sole and entire responsibility. They remain responsible for their actions in connection with the use of this service and are answerable for them before the competent courts.
Any breach of these terms and conditions that causes damage or constitutes a violation of regulatory or legislative provisions may be prosecuted directly against the customer, thereby releasing the service publisher from all liability in this regard.
3. ORDER PLACEMENT PROCEDURE AND DESCRIPTION OF THE PURCHASING PROCESS
Product availability is indicated on the website in each item’s description.
To place an order, customers can select one or more items, customize them if applicable, and add them to their cart. Once their order is complete, they can access their cart by clicking the designated button.
By viewing their cart, customers can check the number and type of items they have selected, along with each item’s unit price and the total order price. They can remove one or more items from their cart.
This summary will also inform customers whether they have the right to withdraw from the purchase and, if so, the applicable time limits.
If customers are satisfied with their order and wish to confirm it, they can click the confirmation button. They will then be taken to a form where they can either enter their login details, if they already have an account, or register on the website by completing the form with their personal information.
Once connected or after completing the form in full, customers will be asked to check or amend their delivery and billing details, then proceed with payment by being redirected to the secure payment interface.
Once payment has been received by the website publisher, the publisher undertakes to acknowledge receipt to the customer electronically within a reasonable time.
Likewise, within the same time frame, the publisher undertakes to send the customer an email summarizing the order and confirming that it is being processed. This email will also include all information relating to the order, the products ordered, their delivery, and the procedures for exercising the right of withdrawal.
4. PRICES
The prices displayed on the website are exclusive of taxes and shipping costs. These prices may be changed at any time by the publisher. The displayed prices are valid only on the date of the order and do not apply to future orders. The price applicable to the customer is the one in effect when the order is placed.
Delivery costs will in all cases be indicated to the customer before payment. In this regard, the customer should contact customer service if the delivery location is not offered during the ordering process.
For deliveries outside the customs territory of the European Union, the customer is advised that customs duties and other taxes may be payable. The publisher is not responsible for the required formalities or payment of these duties and taxes, which shall in all cases be borne by the customer. It is therefore the customer's responsibility to check all such information, as well as whether the product can be imported, with the competent authorities in the destination country before placing an order.
5.RETENTION OF TITLE CLAUSE
The products sold remain the property of the publisher until paid for in full, in accordance with this retention of title clause. Risk is transferred to the customer upon delivery.
6.PAYMENT INFORMATION
Users can place orders on this website and pay by PayPal or credit card
Credit card payments are processed through secure transactions provided by PayPal and Shopify. For credit card payments, the website publisher has no access to any data relating to the user's payment methods.
7.DELIVERY OR AVAILABILITY
Orders are delivered by the carrier selected by the customer when finalizing the order, within an estimated period of 1 to 10 business days from the time the publisher has received full payment for the order.
Certain products or order quantities may nevertheless require a longer delivery time. The customer will be explicitly informed of this when confirming the order.
As the carrier is selected by the customer, The seller cannot be held liable for delays, losses, damage or any other problem occurring while the package is in transit with the delivery service. Any complaint relating to transportation must be addressed directly to the carrier concerned.
The customer is responsible for checking the condition of the package upon receipt. If it is visibly damaged, the customer must refuse delivery in order to benefit from the guarantees offered by the carrier. In this case, the customer must also inform the seller without delay so that a replacement package can be prepared and shipped as soon as the returned package is received. Accepting a damaged package is the sole responsibility of the customer.
In such cases, the delivery times originally indicated will no longer apply.
Pre-ordered products
Some products may be offered for pre-order when they are temporarily out of stock. Pre-ordering allows customers to reserve products and receive priority shipment as soon as they are restocked.
A pre-order does not constitute a request for immediate shipment of the products as soon as they are back in stock. Unless expressly requested by the customer, pre-ordered products are held and then shipped with the customer's next order placed on the site, at no additional shipping cost.
If the customer wishes to receive only the pre-ordered products as soon as they are restocked or before placing a new order on the site, a separate shipment can be arranged upon payment of the corresponding shipping costs. The customer is invited to contact customer service to find out the cost and arrange this shipment.
At any time before the pre-ordered products are shipped, the customer may cancel their pre-order. In this case, the amount corresponding to the canceled products will be refunded as store credit (a voucher) valid on the site.

10.1 CREATING A PERSONAL AREA
Creating a personal area is a prerequisite for placing any order on this website. To do so, members will be asked to provide certain personal information. Members agree to provide accurate information, or their customer account may be deleted.
Certain information is required to create a personal area and validate the contract. If a member refuses to provide this information, they will be unable to create a personal area and, consequently, validate their order.
10.2 OPERATION
This area allows the customer or member to view all orders placed on the website and update their personal information.
If the data contained in the personal area is lost due to an unforeseen event, technical failure, or force majeure, the website publisher shall not be held liable, as this information is provided for informational purposes only. The publisher reserves the exclusive right to delete the account of any member who has breached these terms and conditions (including, but not limited to, knowingly providing inaccurate information when registering and setting up a personal account), or any account that has been inactive for at least one year. Such deletion shall not constitute grounds for a claim by the excluded member, who shall not be entitled to any compensation as a result.
This exclusion does not prevent the publisher from taking legal action against the member where justified by the circumstances.
10.3 PASSWORD
When creating a personal account, users are invited to choose a password. This password ensures the confidentiality of the information contained in their personal account, and users must not disclose or communicate it to any third party. Otherwise, the website cannot be held liable for unauthorized access to a member’s account.

The newsletter may contain information about the publisher’s business. Users who do not wish to provide the information required to create a personal account will not be able to place an order on the website.
The data collected is necessary for the proper administration of the services offered on the website and for the publisher to meet its contractual obligations. The publisher retains this data solely in that capacity and undertakes not to use it for any other purpose or disclose it to third parties, except with the users’ express consent or as required by law.
The contact details of all users registered on the website are stored for a maximum of six months from the deletion of their personal account, a reasonable period necessary for the proper administration of the website and normal use of the data. An IP address is a series of numbers separated by dots that uniquely identifies a computer on the Internet.
The publisher must provide all personal data relating to an internet user to the police (upon judicial request) or to any person (upon court order). The IP address of any computer may be matched with the subscriber's actual identity, as held by the ISP (internet service provider).

This cookie stores information about browsing activity on the website (date, page, times), as well as any data entered by internet users during their visit (searches, login, email, password). These cookies are intended to remain on the internet user's computer for a variable period of up to one month, and may be read and used by the publisher when the internet user visits the website again.
13.2 RIGHT TO OBJECT TO THE PLACEMENT OF COOKIES
Internet users can block this cookie, change how long it is stored, or delete it using their browser interface (generally: Tools or Options / Privacy). 13.3 DELETING COOKIES
Internet users may also delete cookies already stored on their computer by going to the relevant menu in their browser (generally, Tools or Options / Privacy). This will not affect their browsing on the website, but users will lose all the benefits provided by the cookie. In that case, they will have to enter all their information again.
14. EXEMPTION FROM THE PUBLISHER’S LIABILITY IN CONNECTION WITH THE PERFORMANCE OF THIS CONTRACT
If the customer is unable to access the website due to technical or other issues, they may not claim to have suffered harm or seek any compensation.
The unavailability of one or more products, even for an extended period and with no time limit, shall not constitute harm to internet users and shall not give rise to any compensation payable by the website or its publisher.
The publisher shall under no circumstances be held liable for the failure to perform or improper performance of the contract that may be directly or indirectly attributable to the customer or to a force majeure event, as defined by the French courts.
The visual representations of the products published on the website are guaranteed by the publisher to be an accurate reflection of reality, in order to fulfill its obligation to provide complete information. However, given the current state of technology, how these representations look, particularly in terms of color or shape, may vary significantly from one computer to another or differ from reality depending on the quality of the graphics hardware and screen or the display resolution. Under no circumstances may these variations and differences be attributed to the publisher, nor may they give rise to any liability on its part.
The hyperlinks on the website may lead to other websites, and the publisher of this website shall not be held liable if the content of those websites contravenes applicable laws. Likewise, the publisher of this website shall not be held liable if an internet user suffers harm as a result of visiting any of those websites.
15.INTELLECTUAL PROPERTY RIGHTS RELATING TO MATERIAL PUBLISHED ON THIS WEBSITE
All elements comprising this website are protected by intellectual property laws.
Internet users therefore acknowledge that, without authorization, any full or partial copying and any distribution or use of one or more of these elements, even if modified, may result in legal proceedings being brought against them by the publisher or its rights holders.
This protection shall cover all textual and graphic content on the website, as well as its structure, name, and graphic design.
16.AMENDMENTS TO THE TERMS AND CONDITIONS
These terms and conditions may be amended at any time by the website publisher or its representative. 18.AMICABLE DISPUTE RESOLUTION
Except where mandatory law provides otherwise, any disputes that may arise in connection with the performance of these terms and conditions may, before any legal action is taken, be referred to the website publisher for consideration with a view to reaching an amicable settlement. It is expressly stated that requests for an amicable settlement do not suspend the time limits for bringing legal action.
19.SEVERABILITY
If any clause of these terms and conditions is declared null and void by a court decision, this shall not render the remaining clauses null and void; they shall continue to have effect.
20.NO WAIVER
The parties’ temporary or permanent failure to invoke one or more clauses of these terms and conditions shall in no way constitute a waiver of their right to invoke the remaining terms and conditions.
